Chairman Gardiner, after acknowledging that none of the BZA members knew where the right-of-way lay, asked if anyone in the room had objections to granting the variance to the setback requirement. No one spoke out and the Board voted to approve the variance.
“I’m for approval but against the basis under which we’re operating,” commented Forward.
Luke suggested that maps be obtained from the State Highway Department showing right-of-ways on all county roads. > Davis added that the Department would supply maps indicating how far the right-of-way extends off on each side of the center line.
“Who’s job is it to ask the state?” Forward inquired.
Luke, who is Chairman of the Rappahannock Supervisors, volunteered to get the information.
