The Rappahannock Planning Commission received a request in February to amend the county zoning ordinance to allow trailers outside off, mobile home parks as' residences for farm laborers. At that time, the planners expressed doubt that trailers could be permitted for farm workers only and not for the public as a whole.
The same legal question came up recently in neighboring Fauquier County. Fauquier ordinances permit farm trailers with a special use permit granted by the supervisors. The renewable permit is granted for one year if:
—The applicant is the owner of the farm on which the trailer will be located.
—The occupant of the trailer is a full-time farm worker. The occupant must be a tenant and cannot be the owner of the farm.
—There is no other housing available on the farm for the tenant.
At the March meeting of the Fauquier Board of Zoning Appeals, the board members decided to send a memorandum to the county supervisors, asking them to review the farm trailer law for possible revision.
The appeals board members stated that they had found past enforcement of the law distasteful and “probably unconstitutional.” They questioned the legality of the law, predicting that it would be struck down if ever challenged in court.
“I doubt if it's legal to say that a farmer (tenant) can use a trailer for low-cost housing and someone else can’t” commented one member. No date has been set for a hearing on the Fauquier County Trailer ordinance. It is expected that the supervisors will take up the issue as part of the ongoing revision of the county’s zoning ordinance.
