The Federal Energy Regulatory Commission (FERC) under regulations which it issued pursuant to the Public Utility Regulatory Policies Act of 1978 (PURPA) is requiring electric utilities, including The Potomac Edison Company (Company), to gather and furnish to the FERC and others voluminous information by November 1, 1980. This notice is a summary of an application dated October 31, 1979 submitted to the FERC, the Virginia State Corporation Commission, the West Virginia Public Service Commission, the Maryland Public Service Commission and in which the Company seeks authorization to furnish certain information in a form different from that specified in FERC regulations.
The regulations require that certain cost information be furnished, and customer load studies be done, for each of the four regulatory bodies having jurisdiction over the Company's operations. The Company substantially gathers cost information and conducts load studies without regard to regulatory jurisdiction. The Company operates in contiguous areas of western Maryland, northern Virginia and eastern West Virginia and serves wholesale customers at locations within those combined areas. The Company is a part of the integrated Allegheny Power electric system (System). Regardless of regulatory jurisdiction, all customers are provided with power from the same generating stations located in Maryland, Virginia and West Virginia and Pennsylvania through the same high voltage transmission lines. Lower voltage distribution facilities for serving one of its jurisdictions are similar in design and cost as those for servicing its other jurisdictions. Experience has shown that the Company's cost of serving its various customer classes and the energy use patterns of such customers are similar.
Accordingly, the Company in its application proposes that it be permitted to furnish certain cost information on a company wide basis and conduct load studies on the basis of its company wide operations or where appropriate, on the basis of System operations, and be relieved of the burdensome, and costly, requirement of gathering certain cost information and conducting load studies for each of its regulatory jurisdictions.
The regulations also require that» certain rate base information be provided on the basis of thirteen monthly averages if a state regulatory commission so requires. The Company in its application requeste exemption from this requirement now even though a state regulatory agency may in the future require filing of the information on that basis:
