DETERMINATION OF RATES, TERMS AND CONDITIONS

FOR PURCHASE AND SALE OF ELECTRICITY BETWEEN

POTOMAC EDISON COMPANY AND

QUALIFYING COGENERATORS AND SMALL POWER PRODUCERS

Notice is hereby given that the Virginia State Corporation Commission has established Case No. PUE800114 and scheduled a public hearing on January 28, 1981, at 10:00 a.m. in the Industrial Commission’s 3rd Floor Courtroom, Jefferson Building (formerly Blanton Biiilding), Bank and Governor Streets, Richmond, Virginia, for the purpose of determining the rates, charges and conditions for the sale and purchase of electric energy between Potomac Edison Company (“Potomac Edison” or “Company”) and cogeneration and small power production facilities which obtain qualifying status under Section 210 of the Public Utility Regulatory Policies Act of 197B(PURPA).

Pursuant to Section 210 of PURPA and the corresponding Federal Energy Regulatory Commission (FERC) regulations, each electric utility is required to sell electric energy to qualifying facilities at reasonable and nondiscriminatory rates, and to purchase available electric energy from qualifying facilities at a rate reflecting the cost that the electric utility can avoid as a result of obtaining energy from a qualifying facility (“avoided cost”).

In accordance with Section 210, Potomac Edison has filed with the Commission projections of its “avoided costs” and its construction schedules for review and use by the Commission in setting appropriate rates for the purchase and sale of electric energy between Potomac Edison and qualifying facilities. In addition, Potomac Edison has been ordered by the Commission to file on or before January 7, 1981, proposed rate schedules for the purchase and sale of electricity between Potomac Edison and qualifying facilities; together with testimony in support of its position. Copies of this data may be reviewed in the Commission’s ■ Document Control Center, Floor Bl, Jefferson Building (comer of Bank and Governor Streets), Richmond, Virginia, and at any Potomac Edison office where customer bills may be paid.'

On or before January 23, 1981, all persons who expect to submit evidence at the public hearing as a party .protestant, and to cross-examine Potomac Edison’s witnesses, must file a Protest in conformity with the Commission’s Rules of Practice and Procedure, simultaneously serving a copy upon Potomac Edison; notice of protest is waived for this proceeding. Service upon Company shall be made on Philip J. Bray, Esquire, Downsville Pike,.Hagerstown, Maryland 21740. . ;

On or before January 23, 1981, all protestants shall file an original and ten' copies of the prepared testimony and exhibits of all their respective witnesses who are expected to appear at the hearing, and shall serve a copy thereof upon Company.

Any interested person (public Witness) who desires to make a statement at the hearing in his or her own behalf, either for or against Potomac Edison's proposed rate schedules and supporting data, need only appear in the Commission's Courtroom at 9:45 a.m. January 28,1981, and complete an appearance form which will be provided by the Bailiff. All such persons will be heard as expeditiously as possible, beginning at 10:00 a.m., on that date. < „/ «.: ,v•.
