Sharon Genebach Luke, attorney for Mills, emphasized that Rappahannock’s ordinances don’t include requirements for screening, noting that other garages haven’t been asked to proceed with this expensive undertaking. She noted that Bullock and William Kelly, both adjacent landowners opposed to Mills’ request, have a large farm of a couple hundred acres which they’ve subdivided into lots. The subdivision has substantially increased the usage of the private lane that runs between their land and Mills’ garage, the same road on which they want evergreen screening, according to Mrs. Luke.

Screen Subdivision

“To many people, a subdivision is worse than a garage,” she said. “It’s no more Mr. Mills’ obligation to screen their private road from his garage than it is for them to screen their subdivision,” Mrs. Luke maintained.

“How many lots are in that subdivision?” the supervisor chairman asked.

Bullock replied that most of the property lies in Culpeper County. The subdivision lots, 11 total, are in the back wooded portion of the parcel. The open agrarian land opposite Mills' garage and bordered by the private road has been in continual farm use, Bullock said. "They are land developers,” Mrs. Luke countered. “I don’t think it’s Mr. Mills’ responsibility to protect their investment.” “If Rappahannock County doesn’t tighten up its ordinances, we’ll have more and more controversy, more and more lawsuits,” Carrigan said, repeating his proposal for tabling Mills’ rezoning request until the ordinances are updated with provisions for screening and conditional zoning included.
