Homer Henry, former owner of Castleton Farms, challenged Biddle's contention that the 19 acres involved in the permit application had not been used recently for agricultural purposes. “It was used for grazing all this summer by Ray Cannon,” he said.

Zoning Questioned

Henry also questioned whether the land was under 14 per cent slope, the basis for determining whether land is zoned agricultural. “Take the flood plain and the pond out and I think this tract will be more than 13 per cent grade. ” he maintained, particularly citing the area immediately around the proposed apartment building.

“It seems to me like the septic fields are very, very close to the neighboring property line for that much sewage." Henry continued, pointing out that the sewage disposal system would also require a pump but that none was shown in the development plan.

“The plans are very vague. They don't spell out anything.” Henry continued. According to Castleton Farms’ former owner, the proposed parking space is so inadequate that cars won’t have room to turn around and will instead have to back out on the road. He pointed out that all seven units are supposed to have fireplaces yet the development plans show not a single chimney on the building.
