A criminal complaint filed against Admiral Josef Gardiner of Flint Hill last Wednesday led to the issuance of a warrant for the chairman of the Rappahannock Board of Zoning Appeals.
The complaint lodged by Washington attorney David Konick with the District Court clerk on March 11 alleges that Gardiner failed to Tile real estate disclosure forms.
The Virginia Code section 2.1-353.1 requires members of boards of supervisors, planning commissions, town councils, boards of zoning appeals and assessors to file disclosure of all real estate interests and holdings in the county in which they serve by December 31 with the clerk of the circuit court.
In addition, the requirement applies to spouses and family members residing in the same house as the county officials. Once filed, the forms become public record.
Section 2.1 -354 of the Code states that willful violation of the disclosure requirement constitutes malfeasance in office and upon conviction, sets penalties as forfeiture of office.
