If the judge decides he has no authority to grant a writ of certiorari, Dickey said, “There is no zoning ordinance. Then we’re entitled to a building permit without any conditions.” If the judge reviews the council’s conditions, Dickey says he will .probably file a new writ of mandamus against town zoning administrator David Konick. “The ordinance is void and he knows it,” Dickey contends, adding that decisions made from an illegal ordinance are likewise void.
As a parting shot, Dickey accused the town of undue delay. The Inn’s application had been before the town council for the past seven months, he said, “and Newbill Miller says we always have time limits and we’re always in a rush —amazing!”
