While The Inn’s lawyer, David Dickey, asserts that the town lacks any valid zoning ordinance, he has acted under the ordinance’s procedures for appeal, he tells clerk Diane Bruce in a fetter dated December 27. “It would appear that, since the town council has appropriated to itself the role of the board of zoning appeals, the provisions of law relating to boards of zoning appeals would apply," he said, “but I share the judge’s concern on this matter, and filed the petition for a writ of certiorari on the legal theory that my clients might well be estopped fron^ other remedies should they fail MVavail themselves of the Vejnedy provided in the ordinance, even though they take the position that the ‘ordinance’ is — for a number of reasons — void.”
