Eastham testified that he returned Thompson’s Qp from his coat pocket, “eitheP' because time was awasting or, as some stories have it, because the hammer of his revolver caught in the lining of the coat pocket,” his great nephew reported. “Bob Eastham, to the end of his life, always owned and used the very best qualify fire arms; I own specimens of them. The gun he was carryf ing that day was no ‘Saturday night special’ of inferior quality and he was a master marksman in its use. He hit Thompson with all four of his shots, in the abdomen and upper thigh, wounding him mortally.”
Thompson was taken to the hospital in Cumberland, Maryland, where he died two days later. Two more days passed before Eastham was arrested on a murder charge and imprisoned in the Tucker County jail in Parsons.
