Statg law also requires appointment of a board of zoning appeals at the time a zoning ordinance is adopted, Dickey added. While a new ordinance was in the works, Dickey said, there could be no controls on building. According to Dickey, there are “four or five” state supreme court cases saying that if a zoning code is thrown out, the municipality may not place a moratorium on building. As an extreme example of what could happen, Dickey referred to “entrepreneurs lurking in the background” who may be ready to place a McDonald’s or Holiday Inn in the center of historic Washington. “The Inn has real consideration for the way the town looks,” he said, “and that would be a real shame.”
