ALTERING THE SALES AGREEMENT
Probably the most important document in the purchase of real estate is the purchase and sales contract. Most of these come in preprinted form, devised either by local or state real estate boards. In its simplest form, the blanks are filled in where appropriate. If there are no changes or additions, it’s utopia. However, this is not usually the case where two parties are involved.
Basic preprinted contract forms can be modified simply by crossing out unacceptable language and inserting changes. Such revisions must that be initialed by all parties to the agreement. If you object to an entire section of a preprinted form or want to add new material, it’s best to write new language on a separate piece of paper and attach it to the basic contract. Such "addenda” must be signed by both buyer and seller to be valid.
Make sure the basic contract indicates the eiistencs of addenda so that accidental detachment will not undetermine all your work. Modifications can be originated by either party.
