Editor’s Note: This summary was presented to Rappahannock’s Supervisors and Planning Commissioners during joint work session July 18 on the proposed Zoning Ordinance.

The present ordinance is somewhat vague, misleading and contains provisions which are of questionable legality as presented. The zoning map is also confusing and needs clarification.

Intent

The intent of the zoning ordinance revision is to clarify the provisions and to put the provisions in a more legally supportable framework.

New Terminology

• Overlay District: A zoning district which is overlayed on top of another district such as Agriculture or R1. It imposes special restrictions over and above those of the underlying district. “Historic” or “floodplain” districts are examples of overlay districts.

• Special Exception: A special exception use is a use permitted in a basic district by obtaining a special exception permit. This permit is obtained by initiating a request for same with the zoning administrator and it may be granted by the Board of Supervisors after receiving a recommendation from the Planning Commission.
