The Board of Zoning Appeals denied James and Edna Scott’s request for a variance for the location of a pond on their property at Chester Gap. The members split on the decision 2-1, with Chairman Lee Bird and Butch Zindel voting to deny the variance and Sid Gottleib voting for it.

Mr. Scott had built the pond on his .84acre property in the summer of 1988. The zoning ordinance requires that ponds be located 100 feet from all property lines unless written permission is given by the neighbors.

Nothing happened until this past spring, when next-door neighbors Robert and Lucy Rutherford complained to County Administrator John McCarthy. They complained about apparent zoning violation, but also claimed that the pond contained stagnant wa
