agreed that Type-One roads would be required for all subdivisions with five or more lots. Type-Two roads would only be allowed in subdivisions with fewer than five lots. These requirements were sent to the Board of Supervisors as amendments to the zoning and subdivision ordinances to be acted on by the supervisors at their November meeting.
According to County Administrator John McCarthy, Commonwealth Attorney Peter Luke said that since the amendments had been advertised at seven, rather than five, as the number of lots that would require Type-One roads, the amendments had been changed in a way that made them more restrictive. Thus, Mr. Luke advised, the amendments should be readvertised before the supervisors can adopt them. So the board returned the amendments to the planners.
