jested it be made larger. The Rutherfords denied that they had given aermission for the pond. In the meantime, the Rutherfords had filed i complaint with the Health Department alleging that the Scotts had installed an illegal septic system which was possibly draining into the pond. In addition they complained that the drain from the kitchen sink led to a pipe that allowed the water to run out on the ground above the pond.
At the October meeting the BZA members delayed taking action. They wanted to have a report from the health department and to visit the site before voting on the variance request.
Sanitarian Jack Lockhart visited the Scott’s property and told them they should change the plumbing so the drain from the sink w ould lead to the septic system. The Scotts complied with this requirement.
Investigating the complaint alleging leakage of the septic system into the pond, Mr. Lockhart put dye into the septic system on Nov. 1. He checked the pond regularly from Nov. 2-8 and found no evidence the septic system was discharging into the pond. “Existing septic system appeared to be functioning satisfactorily'and was proper distance from pond," Mr. Lockhart’s report concluded.
