WARRF'NTON — A judge on Tuesday dismissed charges that Little Johnnie Jenkins sexually abused a 6year-old girl three times in February of 1992.
The three counts of aggrav ated sexual battery against Mr. Jenkins were dropped in the middle of his jury trial. Mr. Jenkins, 26, of Washington, was indicted by the Fauquier County Grand Jury last year.
After assistant commonwealth's attorney Kevin Casey presented his case, Mr. Jenkins’ attorney, Daniel Flynn, made a motion that the charges be dismissed.
Mr. Flynn argued that the prosecution’s case relied on a taped confession Mr. Jenkins made to police on Aug. 10, 1994.
Citing other criminal cases with similar circumstances, Mr. Flynn told the judge that the Commonwealth must prove that a crime had been committed.
