In its effort to defend itself against the suit brought by the U.S. Department of Justice, VMI and Virginia established the Virginia Women’s Institute of Leadership (VWIL) within the private all-women Mary Baldwin College in nearby Staunton. The adversative method was not used. Rather teamwork was developed by presenting the much smaller class with challenges that required teamwork to solve.
The Fourth Circuit Federal Court, accepted VWIL as meeting its test that VMI enroll women or the state of Virginia establish an equivalent program for women. The Justice Department appealed that decision,
