accumulates 12 to 17 demerit points in a 12-month period, or 18 to 23 demerit points in a 24-month period is required to attend a driver improvement clinic. After July 1, drivers under 18 years of age will be required to attend a driver improvement clinic if they accumulate nine points within a 12-month period or 12 points within a 24-month period. Qnce the teen completes a driver improvement clinic, he or she will be placed on probation for six months. If the teen acquires additional demerit points during the probation period, his or her license will be suspended.
Virginia’s zero tolerance law prohibits persons under 21 years of age from illegally consuming alcohol and driving with a blood alcohol content greater than .02 and less then .08. However, teens age 16 and 17 years old arrested for driving under the influence were not subject to administrative license suspension. However, another bill effective in April with Governor Allen’s signature, states that a person under age 18 who registers a blood alcohol content of .08 or who refuses to take a breath test may have his or her driver’s license suspended immediately for seven days.
Complementing these new laws, Virginia already has in place a “Use and Lose” law which affects juveniles 13 through 17 years of age adjudged to have violated provisions of this law regarding alcohol possession, consumption and distribution; curfew violations; delinquency and firearms possession, and/or use. Driver’s licensing for teens under 16 may be delayed up to one year, and teens 16 and older could lose their license for up to one year. During 1995, 2,423 juveniles were charged under this section of the code.
Additionally, a parent or guardian may take a juvenile’s license for any amount of time or direct DMV to cancel the license for a six-month period. Furthermore, a juvenile court judge may suspend a juvenile’s license for any number of reasons, including status offenses such as truancy, alcohol/drug-related offenses, delinquency and curfew violations.
