Mr. McCarthy also suggested that the Board review a memorandum prepared by Mr. Luke that addresses the legality of placing cell towers in agricultural/forestal districts. This document was prepared in response to questions by Pat Saltonstall and others at the September Planning Commission meeting, and to her suggestion that the question be put forth to the State Attorney General for his response.
In the memorandum Mr. Luke summarizes the facts of the issue and his review process, and notes that the County Ordinance allows telecommunications facilities by special use permit in any district, but that the Mulkey Mountain District agreement states that "no use requiring a special use permit would be allowed if that use is in conflict with the purposes for which the District was created."
