Under the enabling legislation, any landowner within a farming district may petition the local governing body to withdraw from the district, but the decision will rest with the elected officials. The only exception is in the case of the farmer’s death. The Virginia law allows "any heir at law or devisee of an owner of land” to withdraw immediately from a district, if they so choose.
Dennis asked the Supervisors if the necessary application formjj to create an agricultural district in Rappahannock were available. Supervisor Chairman Pete Luke told him that the Board had not received official word as yet on passage of the law nor had the clerk been sent any forms.
Phil Irwin, president of the Rappahannock League for Environmental Protection, said RLEP was very interested in establishing agricultural districts in the county as a means to help fanners maintain the farming industry. "The enabling legislation is a good example that if the county doesn’t act, the state will,” said Irwin.
