The county Planning Commission members approved another public hearing on Mrs. Davis’ application and set their meeting date for April 5 at 3 p.m. in the courthouse. Commonwealth’s Attorney George Davis, whose wife is requesting the rezoning, explained to the Planners that April 5 was the only date they could schedule the public hearing in order to meet county regulations. (Article 17 of the Rappahannock Zoning Ordinance requires that all applications far change of zoning district boundaries be heard at a legally advertised public hearing before the Planning Commission. The Planners are also required to submit a recommendation to the Supervisors who must hold another legally advertised public hearing on the rezoning.
The Code of Virginia states that legal advertisement is advertising far two successive weeks in a newspaper of general circulation within the county and further requires that the advertised public hearing be held not less than six days or more than 21 days after the second advertisement.)
