The Rappahannock News has been taken to task recently for expressing an opinion on the legality of the BZA action turning down the ski area’s request in its entirety. While we are not lawyers, we try to confine our comments to matters of courtesy—and responsibility, too.

All legal questions aside, the BZA members deserved the right to hear what the Supervisors were contemplating before it was an accomplished fact. These are men who in essence donate their time for the public’s benefit. We may sometimes quarrel with their deicisons but we realize that they’re performing a valuable public service—frequently with small thanks and little appreciation.

We are certain that they believed that they were acting for the good of the county—and within their legal jurisdiction—when they turned down the ski area application for a snowless summer slide and other recreational support activities.

Rappahannock’s Commonwealth Attorney sees the application denial in another light. That is “in his legal opinion.” He told this to the BZA members before they voted on the ski area application and they decided that his advice was incorrect.
