sign. Davis further contends that the sign is within the town limits of Washington and therefore, subject to regulations of the town, rather than county, zoning ordinance.
The town ordinance, adopted in July, 1970, stipulates that signs advertising businesses located in Washington are permitted by right. The town ordinance does not include any setback requirements. Washington’s zoning ordinance also authorizes the County Administrator to serve as Zoning Administrator for the town.
Under the Rappahannock Zoning Ordinance, sigps advertizing local businesses are permitted by right provided the sign has less than 20 square feet in
area. The county ordinance also requires a 55 foot setback from the right of way of any highway or street having a right of way greater than 50 feet. The Lake Motel sign is well within 55 feet of Route 211.
When contacted on Tuesday, Col. McNear denied that his signature on the Highway Department permit constituted authorization for the motel sign. He noted that the Highway Department would not allow any sign within at least 1,000 feet of Route 211 because of Federal regulations.
