On the basis of Estes’s information, Costello acknowledged there was now an ownership dispute but maintained this was something to be worked out with the state. The matter before the BZA, he emphasized, was whether or not to grant a variance on Easton’s shed.
“The shed is there now?” asked Gardiner.
“Yes,” McNear answered, adding that Easton had built the structure without realizing that it violated zoning ordinance regulations. “There’s no way to bring it into compliance because he doesn't have enough land," the zoning administrator repeated.
Admiral Gardiner informed Easton that he’d need a release from his neighboring property owner before the BZA could consider a variance on the zoning ordinance stipulation that requires any structure to be located 25 feet or more from adjoining property lines.
