Many Virginia residents may be operating motorized vehicles (mopeds) under the mistaken impression that they are covered for personal liability claims automatically under their personal automobile insurance policies or under their homeowners policies, the State Corporation Commission’s Commissioner of Insurance, James W. Newman Jr. says.

There are several reasons why moped owners may be misinformed about their insurance coverage. One is that personal liability arising from non-motorized vehicles, such as bicycles, is covered under homeowners contracts, and many people consider mopeds to be bicycles.

However, the homeowners contract excludes liability coverage for any motorized vehicle, except those not licensed for road use and then only while used on the insured premises.

The personal automobile insurance contract covers as owned vehicles only fourwheel private passenger vehicles.

Another reason is that many moped dealers advertise as a moped selling feature the fact that insurance is not required for mopeds.

This is essentially true, in that mopeds are not covered by the state's financial responsibility laws and do not have to be licensed. However, many buyers misinterpret the statement that “no insurance is required" to mean that there is automatic coverage under either their automobile policy or their homeowners policy.
