Curcuit Court Judge Shore Robertson heard arguments last Friday challenging the conviction of Clarence “Pete” Martin on five counts of arson involved in the burning last Halloween of barns and other property belonging to the C. E. Johnson family of Sperryville.
Defense motions filed by attorney Lee Albrecht asked that the verdict in the Martin case be set aside. In written arguments, Albrecht maintained that the
* prosecution failed to prove that the fire was of incendiary origin or that Martin was the criminal agency behind the fire.
Robertson dismissed both points, finding the presumption that the fire started naturally had been overcome by the commonwealth’s "negative evidence” which ruled out natural causes. He
