Asked if Spellman had ever helped her when she had car trouble, she told the jury that once when her car was stalled, he’d stepped out of the bushes and stood, just looking at her with a rifle in his hands, not saying a word until she got the motor running again.
Under cross examina- * tion, Kidwell said she took* the gun from her house on November 9 “to stop further destruction of our property.” When begged by her brother to leave, she admitted saying “No, I’m going to stay here. Leave me alone. Don’t fool with me!” At that moment, she acknowledged, she wasn’t afraid. “Once I was in the truck and got to where I was going to make my stand, I felt better then. I felt secure in the truck,” Kidwell said, agreeing that she “felt protected” with the shotgun.
Asked by the prosecutor if she grew angry watching Spellman operate the bulldozer, Kidwell said she “got upset and mad and sad and hurt.” As she sat watching For 10-25 minutes, she saw Spellman at one point reach n his jacket and pull out a cigarette, Kidwell said, acoiowledging that she never saw a weapon.
