In the only rebuttal witness called by the prosecution, Trooper Baines reported that Spellman’s prior criminal record consisted of a single conviction for trespassing in 1974 for which he was fined $28.
After the attorneys finished debating instructions to the jury near noon, Merrill began final arguments for the Commonwealth. Asking for a conviction on first degree murder, the special prosecutor said that the shooting of Spellman was “not a complicated case.” He maintained that the defense had thrown out a series of “red herrings and smoke screens” aimed at putting Spellman in the defendant’s place, confusing the issue and taking attention away from the time of the killing.
