After dismissing the jury and declaring a mistrial following the panel’s eight hours of deliberations, Judge Horne denied a motion from attorney Peter Luke on behalf of the Rappahannock News, requesting that closed portions of the record in the proceedings be opened to the public.
On behalf of the defense, Dowd restated his earlier objection to opening the record, which includes two prior hearings held in Rappahannock and Leesburg.
Merrill told the court that he had no objections to Luke’s request.
In denying the motion, Judge Home granted Luke leave to renew his request when the proceedings against Kidwell are at an end.
