Donald Ray Bright, of Sperry* ville, pleaded guilty Tuesday to a misdemeanor charge of vandalizing a state vehicle, and was sentenced to 12 months in jail by Rappahannock General District Court Judge Charles Foley.
In asking for a jail sentence, Commonwealth’s Attorney Peter Luke said that “In this county, we have a problem with vandalism of state vehicles. They have to be left on the highway, where they are sitting ducks for vandals. It is an expensive proposition for the taxpayers.”
State Trooper C. A. Moore testified that the incident occurred on an evening last fall when a large crowd had gathered around the vehicles, which were parked on the shoulder of Rt. 211 just outside Sperryville. One tire on each of the two vehicles was slashed with a knife. He said that the damage was substantial, due to the large replacement cost of thetire8.
Trooper Moore testified that he interviewed Bright, who told him that he had been drinking, and said that “I’m not going to say I didn't do it and I’m not going to say that I did - because I don’t know.”
Mr. Luke said that Bright admitted to him that he had committed the vandalism, and asked that as a result of that confession similar charges against one of Bright’s companions be dropped.
In passing sentence, Judge Foley said “The court believes a jail sentence is appropriate,” and sentenced Bright to 12 months in jail, with 11 months suspended on condition of good behavior. Judge Foley also directed that Bright make restitution to the Highway Department, and pay the cost of the prosecution.
