In a written memo to the commission, Mr. McCarthy noted that the Code of Virginia provides for voluntary proffer of reasonable conditions as part of a rezoning request. The property’s use as a restaurant, with all floor plans, parking plans and other arrangements, would be the basis of a rezoning, he explained. “Should this use ever cease, then the property would revert to its original zoning. Further, any substantial alterations to the structure or use would require public hearing” and approval from the Board of Supervisors, Mr. McCarthy advised.

“I’m willing to do that,” Mrs. O’Brien told the commissioners.

“She can proffer that if the use of the restaurant ceases, the property reverts to residential zoning?” asked Commissioner David Fannon.

“Yes, sir,” answered the zoning administrator, confirming that this arrangement would be legal under Virginia law with Mrs. O’Brien’s written offer to the Board of Supervisors prior to that body’s public hearing on her rezoning application.

“And you’re willing to sign that?” Mr. Fannon questioned.

“Oh, yes,” Mrs. O’Brien replied.

Mr. Irwin, the only speaker at the public hearing on her request, called the restaurant an “appropriate use” for a “unique structure.” While warning that the county is experiencing “an explosion” in touristrelated business, the bed-and-breakfast proprietor maintained that the competition is good for similar existing enterprises. “Everything will work out in a free market place,” he said. Telling the planning commissioners that they’ll get a permit application from a bed-and-breakfast in Huntly next month, he predicted that Rappahannock could become “the bed-and-breakfast capital of Virginia.”

With Mrs. O’Brien’s promise of a conditional zoning proffer, the commissioners voted unanimously to recommend approval of the rezoning.
