• Employer verification obligations and sanctions affect all employers with one or more employees.

• The employer has an obligation to not knowingly employ an alien once he or she becomes “out-of-status” even though the alien was in legal status at the time of hiring.

• Some sanctions are effective prior to June 1, 1988 if prior warnings of noncompliance were given after June 1, 1987. Enforcement with respect to seasonal agricultural services is deferred, however, until Dec. 1, 1988. An exception to this delay is the recruitment of an unauthorized or undocumented alien who is outside the United States at the time.

• The farmer is the ultimate employer and is nof protected from liability just because the labor contractor or crew leader says that all of the workers are authorized.

• State employment agencies are not required to perform the verification and record-keeping functions required by the new law.

• The penalty for violation of the verification and record-keeping requirements is a fine of not less than $100 nor more than $1,000 for each employee found in violation.
