If the board decided to challenge the legality of the subdivision, “you’re going to have trouble explaining to a judge why they were shown as seven separate lots in the land books since 1969 and taxed as such, and now you’re saying that they’re not valid . . . Good or bad, I think they’re here,” Mr. Luke concluded.
“I don’t particularly like it, but I think they’re legal lots,” seconded County Administrator John McCarthy.
By consensus, the four board members agreed to accept Mr. Luke’s recommendation.
“I’ve got my walking papers. That’s fine,” noted Mr. McCarthy, saying he needed no formal vote directing him to accept the subdivision as valid.
