“I agree with that, but we already have the mechanism," noted Chairman Hubert Gilkey. “We can just say no to rezonings.”
A moratorium denies landowners due process by taking away their right to come before the Board of Supervisors to state their case. Mr. Luke explained. “Courts don’t like that, but they don’t mind if you say no.”
And the resolution, which the board unanimously endorsed, “sends the message loud and clear," Mr. McCarthy added. Until dual-laning corrects the existing safety hazards on Rt. 211, the board “is not going to look favorably on commercial rezonings along Rt. 211," the county administrator concluded.
