PUBLIC HEARING PROPOSED AMENDMENTS:
RAPPAHANNOCK COUNTY ZONING ORDINANCE On Monday, November 6, 1989, the Board of Supervisors of Rappahannock County will consider a series of proposed amendments to the Rappahannock County Zoning Ordinance and Rappahannock County Subdivision Ordinance. The following amendments to the Rappahannock County Zoning Ordinance shall be considered: I. Amend Section 2.4-1 by replacing the words “twenty-five (25) feet" with: “forty (40) feet” also, by adding new sentence at end of section. This exemption shall apply to natural gas lines and facilities which are to provide local distribution only. II. Amend Section 3.3-3 (K.) by adding, after “Sanitary Landfill": (Rappahannock County Governmental Only) III. Section 3.3-8 (D) Delete entirely (reserve for future use) IV. Amend Section 3 5-6 by adding new subsection to read: J. For new residential uses in Commercial zones, there shall be maintained a minimum ten (10) foot side and rear yard setback for principal uses. V. Add new section, to read as follows: 3.8 TEMPORARY MOBILE HOME PERMITS A. In all zoning districts except “HC" Highway Commercial, temporary mobile homes may be allowed by the Zoning Administrator for a period not to exceed one (1) calendar year from date of final occupancy permit issuance.
B. This period may be extended for up to six (6) months upon application to the Zoning Administrator satisfactorily demonstrating the existence of extenuating circumstances not controllable by the permittee. C. This permit will be issued only to applicants who can show that a mobile home is needed while he or she is constructing, reconstructing or remodeling his or her intended permanent dwelling and will be immediately and irrevocably revoked upon issuance of final occupancy permit for said permanent dwelling. D. Application: a. ) Applicant shall, on forms provided by the Zoning Administrator, file an application for a temporary mobile home permit no less than thirty (30) days prior to the intended date of said permit's taking effect. The application forms shall provide such information as the Zoning Administrator shall find to be necessary for the fair administration of this Ordinance. b. ) The Zoning Administrator shall, within five (5) days of filing such completed application, by letter notify adjacent property owners of the filing of the application, where and when it may be reviewed by interested parties and the last date that comments will be accepted for consideration. c. ) Upon determination that the application meets such standards as set forth in Sections A through C, above, the Zoning Administrator shall issue a Temporary Mobile Home Permit, setting forth all applicable conditions, restrictions, and time limits. VI. Section 5.9-3 Delete entirely (reserve for future use). VII. Amend Section 8.3-1 B. by rewriting Section to read: Type ll-Developments serving seven or fewer lots or which are expressly approved in conjunction with a Special Exception permit. VIII. Delete Section 8.3-1 C. IX. Amend Section 8.3-2 B. by rewriting Section to read: Type ll-No Type II private streets shall serve more than seven (7) lots unless expressly approved in conjunction with a Special Exception permit. X. Delete Section 8.3-2 C. XI. Amend Section 8.3-3 B. by rewriting Section to read: Type ll-Such facilities shall be designed to meet minimum applicable requirements as contained in the Appendix of the Rappahannock County Subdivision Ordinance. XII. Delete Section 8.3-3 C. XIII. Delete Section 8.3-4 B. XIV. Amend Section 8.3-5 by deleting “and III" from end of last sentence. The following amendments to the Rappahannock County Subdivision Ordinance shall be considered: I. Amend Appendix by changing “12-minimum width” to ”20’ minimum width" for Travel way. II. Amend Appendix by adding new line after "Crown", to read: Specified Road.
