Those who qualify for Virginia Tax Amnesty are individuals and businesses that failed to file a return due before Nov. 4, 1989; those who under-reported income on any return due before Nov. 4, 1989; taxpayers who overstated deductions or exemptions on any return due prior to Nov. 4, 1989; or those who received a bill from the Department of Taxation with an assessment date before Nov. 4, 1989. Anyone under criminal investigation or prosecution for filing a fraudulent return or failing to file a return with the intent to evade the tax is not eligible for Tax Amnesty, Commissioner Forst noted.

In order to get amnesty, taxpayers must file the Amnesty Request Form (AM-8) and attach copies of any unfiled returns, and pay all tax and interest due no later than March 31. Virginia Tech Amnesty forms may be obtained through any one of nine Department of Taxation offices or through local commissioners of the revenue, directors of finance or supervisors of assessments.
