judges who hear the majority of Rappahannock’s docket: Burke Hertz, W. Shore Robertson and Judge Foley. “I feel we’re lucky that in Virginia we have a very highquality judiciary,” he said, especially compared to states where judges are elected (in Virginia the General Assembly appoints them).

“And they don’t rule for me all the time either,” he said.

Mr. Luke said the national blight of substance ^abuse plays a role in about 80 percent of non-traffic cases he tries. ‘The cost to society of people who abuse substances [including alcohol] is tremendous in terms of the criminal-justice system,” he said.

He tries, in cases where it applies, to always obtain restitution for victims “to make them whole,” he said. And he tries to minimize the number of times victims have to appear in court, sometimes by going straight to Circuit Court for an indictment to bypass a preliminary hearing in General District Court.
