Wakefield suit
Circuit Court Judge Thomas D. Horne has delayed for about six months a hearing on the status of several loans in dispute following the breakup of Wakefield School in Marshall and Wakefield Country Day School in Huntly.
The judge granted a motion by Wakefield School of Marshall to continue the case because, he wrote, “A number of issues remain to be addressed in this case. Preliminary motions need to be disposed of prior to trial. The Court does not believe this case can be bifurcated. While there is a suggested urgency to hearing the matter of the Farmers & Merchants loan, it would appear that any such hearing might affect collateral findings which may be binding upon the parties....A hearing in this case scheduled in six months would seem to satisfy the need for hearing preliminary motions, completion of discovery, .and proper preparation for trial.”
