Rappahannock Newi SUIT Writer ; The Board of Supervisors apparently intends to reenact the ban on sludge, perhaps twice.
At the end of the afternoon session of last Wednesday’s meeting, the board went into executive session to discuss the suit brought against the county by Dale Welch &nd others because of the sludge ban.
Then after adopting the county code, which contains the sludge ban, in the evening session, the board unanimously adopted two resolutions to hold hearings on banning the land application of sludge.
The hearings were tentatively scheduled for 7 p.m. Monday September 12 in the high school auditorium. \
The first hearing, a joint one with the Planning Commission, is to consider an amendment to the zoning ordinance to ban sludge in all zoning districts. That is similar to the current ban. The second hearing would be on a ban to be part of the county code under Health, citing the county’s “general powers” under the Code of Virginia and power to prevent the pollution of water, also referencing the Virginia Code.
Portions of the suit against the county concern the manner in which the ban was adopted claiming that the Board of Supervisors adopted the ban without stating a reason for the action and without giving adequate consideration to evidence supporting the land application of sludge.
The resolutions to hold the hearings appear to address these issues.
