The sale of this property is subject to any easement, restrictions and matters which may be of record including the right of way agreement in Deed Book 145, page 689, any unfiled or unrecorded mechanic's liens, all liens which may affect the property, and the rights, if any, of any parties in possession. Obtaining possession of the property shall be the responsibility of the purchaser.
TERMS OF SALE: Cash with a successful bidder’s deposit of 10% of the sales price in cash or certified check or such other funds as may be acceptable to the substitute trustee at time of sale and balance upon tender of Special Warranty Deed, settlement to be held on or before February 28, 1997, at 11:00 a.m., time being of the essence, in the Circuit Court Clerk’s Office of Rappahannock County, Virginia. The Substitute Trustee reserves the right: (1) to waive the deposit requirement, (ii) to approve the creditworthiness of any bidder; (iii) to , withdraw the property from sale at any time pnor to the termination of the bidding; (iv) to keep the bidding open fqr any length of time; (v) to postpone the sale one or more times as he may deem advisable; and (vi) to require a cash bidders deposit of 10% of the sales price before any bid is received. In the event the purchaser should fail to complete his purchase as set forth above, the deposit shall be retained by the Substitute Trustee and applied to the costs and expenses of the sale and the balance, if any, to be retained by the Substitute Trustee as compensation for said sale. Examination of title, conveyancing, and recording fees shall be at the expense of the purchaser. Purchaser shall assume any unpaid taxes for the current year subsequent to the date of auction.
