He noted further that in almost every fatal crash, the cyclist was either violating a law or performing a foolishly dangerous act. As examples, seven were killed on unlighted bicycles at night and four entered traffic not at intersections. The same is substantially true in injury cases.
“A bicycle in traffic is not a toy but a vehicle. The rider is usually of an age too immature to operate an automobile, yet he is without the protection of a steel body and more vulnerable than a pedestrian in that he cannot maneuver as easily,” he concluded.
