A CHARGE of hunting without a license brought by Game Wardens against a member of the Rappahannock Hunt has been dismissed by Judge William Carson on grounds that he was not actually following “dogs while in pursuit of a fox” nor actually managing the dogs at the time the warden asked him to display his license.
Judge Carson issued a written order of his finding in the case of the Commonwealth vs. John Lyle, which came before him in General District Court on February 20. The Judge’s order is as follows:
“This day came the defendant by counsel in answer to a charge of fox hunting without a license and came also the Attorney for the Commonwealth.
