VIRGINIA: IN THE CIR CUIT COURT OF RAPPA HANNOCK COUNTY

IN RE: PETITION FOR REFERENDUM ON SALE OF MIXED ALCOHOLIC BEVERAGES IN RAP PAHANNOCK COUNTY, VIRGINIA

ORDER

This day came the Petitioners to be heard upon their Petition, filed pursuant to Section 4 98.12 of the Code of Virginia of 1950 as amend ed, asking that a referendum be held on the question, "May mixed alcoholic beverages be sold in the County of Rap pahannock, Virginia, by restaurants licensed under Chapter 1.1 of Title 4 of the Code of Virginia?"

It appearing to the Court, from affidavit duly filed, that the Petitioners have proceeded in the mode prescribed by law herein, that such Petitioners are qualified voters of the County of Rappahannock, Virginia, who exceed in number fifteen percentum (15 per cent) of the number of votes cast by qualified voters of such County and counted for presidential electors in the last preceding presidential election in said County, and that such referendum should be held,

THE COURT DOTH AD JUDGE, AND ORDER that a referendum be held on the question "May mixed alcoholic beverages be sold in the County of Rappahannock, Virginia, by restaurants licensed under Chapter 1.1 (Section 4 98 12 et seq ) of Title 4 of the Code of Virginia?" and the regular election officials of the County of Rappahannock, Virginia, shall open the polls and take the sense of the qualified voters on such questions at the election to be held on November 7, 1978, and the Clerk of the Circuit Court for Rappahannock County, Virginia, shall publish notice of such election in the Rap pahannock News, a newspaper of general cir culation in the County of Rappahannock, once a week for three consecutive weeks prior to such election

The regular election officers of the County of Rap pahannock, Virginia, shall open fhe polls at the regular polling places in said County where votes shall be cast at such election, on November 7, 1978, and during the same hours, as the polling for fhe qualified votes of the County of Rappahannock in the election The election shah be by ballot which shall be prepared by the electoral board of the County of Rap pahannock and shall be in such form and subject to such qualifications as are set forth in Section 4 98 12 of the Code of Virginia of 1950, as amended, and shall state: "MAY MIXED ALCOHOLIC BEVERAGES BE SOLD IN THE COUNTY OF RAP PAHANNOCK, VIRGINIA, BY RESTAURANTS LICENSED UNDER CHAPTER 1.1 OF TITLE 4 OF THE CODE OF VIRGINIA?".
