Regulate Not Manage

He emphasized that the SCC is supposed to regulate, not manage. “We determine only how much it costs to operate efficiently, including a fair return on investments, and then we set rates on that basis.”

Henderson also stressed that the SCC does not GUARANTEE any company a profit. “We only authorize the maximum profit that they are allowed to make,” he said, adding that the company must be managed properly in order to achieve that authorized profit.

Besides controls established by the General Assembly, the SCC must also comply with four U. S. Supreme Court rulings, said Henderson. The first stipulates that no public utility can be compelled to provide service without a fair return; the second that every public utility must be judged separately in rate making
