The suit arose after the B/A voted unanimously to deny the Ski Area's special use permit application tor a snowless gravity slide, skiing, swimming, tennis and other summer support activities. According to Ski Corporation president James Moore, his company couldn't show a profit with just the t w ice bankrupt ski operation and needed the income from a summer recreational venture centered around the Alpine slide.
After the application for a special use permit was denied, suit was initially brought against the Board of Zoning Appeals by the Ski Area. However, the Supervisors petitioned the court for status as an aggrieved party and were allowed to enter the suit on the side of the Ski Area as far as the denial of the special
