To those points. Robertson ordered the NPEA to turn over all books and financial records pertaining to the construction of improvements on the site. In addition. Konick was allowed further time for discovery related to activities going on at the property during the past year.
At Konick's suggestion. Judge Robertson agreed to continue the scheduled July 14 contempt hearing on the NPEA’s compliance with his restraining order until after a hearing on the merits of the BZA's variance. Robertson set a pre-trial hearing on the merits for September 11 at which time he will determine whether to take further testimony.

The grand jury failed to return an indictment on Monday against Glenn Hitt of Castletcn for the shooting death of a Fredericksburg man on May 17.
Testimony at a preliminary hearing on June 24 from Rappahannock sheriff’s department deputy E. W. Thompson III indicated that Glenn Hitt fired in selfdefense at James Franklin Hitt after he forced entry into Glenn Hitt’s home. James
