Later that evening at 11 p.m.. Fox said she’d received a call from Gray who accused her of selling his dogs and said she had no right to be in .Rappahannock County. He telephoned a second time, she stated, and said “if I wanted to feed the puppies. I could cut the nipples off the mother and feed them to the puppies.”
Deputy E. W. Thompson reported that when he saw the dogs, the mother was "extremely thin” and appeared to have little or no milk for her offspring. In addition to the one puppy that Fox found under the bush, Thompson said a second was “barely moving” while the remaining four appeared normal. He also noted that there was no food or water in the yard. According to Thompson. Gray called him too that night at approximately 10:45 and was "very unpleasant”.
