He goes on to state that Lindsey Savage, trustee for the NPEA, applied for a building permit on March 3, 1979, to erect a 50’ by 100’ tabernacle, 40’ by 50’ i re nee hall and 28’ by 40’ restroomstorage building. Approval was given for construction with the permit issued and signed by Patti Alexander, secretary to the zoning administrator.

According to sections of the ordinance cited by Konick, the zoning administrator is allowed to issue , building permits “only when they are in accord or harmony” with ordinance provisions. Building permits granted “in conflict with the provisions of this ordinance shall be null and void,” he quoted.

In the writ of mandamus, Konick pointed out that the NPEA’s building permit was issued by the zoning administrator’s secretary to whom the supervisors “had
