Slope Provisions Vague
Baumgardner suggested that the planners also examine the use of slope as the basis for zoning categories, adding that he thought McNear would agree that it shouldn’t be “the beall and end-all as far as zoning is concerned.” From a legal standpoint, he said, there’s a “real problem” with vagueness when a parcel of land under consideration is partially over and partially under 14 per cent slope.
(Over 14 per cent slope, land is considered in a conservation zone with minimum lot size of 25 acres.
